Terms and Conditions for Motorcycle Tours
Liability Waiver Declaration
- I participate in the trip at my own risk. I am aware of the dangers associated with the tour and the use of the motorcycle, and I consciously accept them. I acknowledge all dangers and risks associated with an off-road or on-road motorcycle tour (enduro tour), particularly the challenging conditions of paved or unpaved roads. I also accept all dangers and risks of training and the associated risks of personal injury, death, property damage, and loss.
- I assure that I meet the requirements set by the tour operator for participation in the tour and that I am in good health. Should any impairments or injuries arise during the tour, I will immediately inform the tour operator. It is solely my responsibility to determine whether my individual abilities and skills are sufficient to handle the given route. The tour operator and tour guides will evaluate skills and abilities within reasonable limits (for example, during a test ride before the start of the tour).
- For my own safety, I commit to wearing the protective gear prescribed by the organizer (including but not limited to a helmet, motorcycle clothing, and protective gear) throughout the entire tour. I acknowledge the authority of the tour operator and their representatives in all matters related to the tour and safety and will comply with their instructions.
- I waive any claims for damages or compensation against the organizer, their representatives, and agents for any incidents or accidents associated with the event, unless they were caused by gross negligence or intent.
- I commit to avoiding any damage to nature and unnecessary disturbances to residents or other third parties during the tour.
Terms and Conditions of Participation
- Registration for Tour Participation
By completing the online application form on the website www.ktm-georgia.com and agreeing to the terms and conditions for the tour , the applicant offers the tour operator the conclusion of an online contract for tour participation.
- Payment
To reserve a spot, the tour participant must make a deposit of 50% upon booking and receipt of the invoice. The exact amount of the deposit will be specified in the invoice. The remaining payment must be made within the period specified in the invoice and no later than 60 calendar days before the start of the tour. All bank transfer fees and other payment-related charges are the responsibility of the customer.
If the remaining balance is paid on-site by EU cards, VISA, or in cash ($/€), a 3% surcharge will apply.
We also accept GEL (Georgian Lari).
- Tour Execution
The tour will be conducted under the conditions and schedules described on the website www.ktm-georgia.com. The tour operator reserves the right to make changes to the route and schedule due to weather changes, flight disruptions, travel delays, or other circumstances beyond their control.
- Accommodation
The tour operator’s application form includes options for hotel accommodations for the tour. The default option is a double room; single rooms can be provided upon request for an additional cost. The exact price is provided on the tour operator’s website.
- Minimum Number of Participants
The tour is a group activity and is dependent on the number of participants. Therefore, the tour operator reserves the right to cancel the tour. In such cases, payments made will be refunded. No further claims are possible. If a tour is canceled, the tour operator will notify the participant in a timely manner via email and refund the amount paid.
- Participant Eligibility
The tour participant is required to realistically assess their motorcycle riding skills and physical health. By registering, the participant declares they are generally healthy and meet the event’s requirements. Should the tour operator determine before or during the tour that the participant does not meet the requirements or that their riding skills are insufficient, the participant may be excluded. Any costs resulting from exclusion are to be borne solely by the participant, and no refund of the tour fee will be provided.
- Cancellation of Tour Participation
The tour operator recommends purchasing travel cancellation insurance. The participant may cancel their participation at any time in writing via email. Processing of the written cancellation requires five working days from receipt of the cancellation declaration.
The participant agrees to reimburse the tour operator as follows:
- 50% of the total amount for cancellations up to 60 calendar days before the tour start.
- 80% of the total amount for cancellations less than 40 calendar days before the tour start (calculated from the departure date of the flight).
Alternatively, the participant may reschedule the booking for a year or transfer it to another person with the tour operator’s consent.
Cancellation fees:
- From the 60th to the 40th day before the start: 60%
- From the 40th to the 21st day before the start: 80%
- From the 20th to the 10th day before the start: 90%
- From the 9th day to the start date: 100%
The reimbursement must be made no later than five working days after the cancellation declaration, deducting the deposit.
- Tour Impracticality
The tour operator reserves the right to cancel or terminate the tour under the following conditions:
- Injuries, illnesses, or technical problems affecting the tour operator or participants that render the tour impractical.
- Dangerous weather conditions, animal or insect behavior, natural disasters, or other force majeure events (e.g., earthquakes, war, floods, political unrest).
In case of cancellation, the participant will be refunded the tour fee or a proportional amount for remaining days.
- Participant Obligations and Agreement
The participant assures they have the ability to ride motorcycles both on public roads and off-road. This will be tested via a trial ride before the trip begins.
- Liability and Insurance
Participants take part at their own risk and agree to bear full civil and criminal liability for damages caused by them.
- Rental Equipment
Motorcycles and protective gear will be provided in good condition, and participants must handle them with care.
- Miscellaneous
Participants agree that photos and videos may be used for promotional purposes
